1. What this site is — and is not

This site provides information about off-market and exclusive real-estate opportunities in the Greater Toronto Area. It is provided for general information and marketing purposes.

Nothing on this site is an offer to sell, or the solicitation of an offer to buy, any property or business. No contract of purchase and sale arises from anything on this site. Any transaction proceeds only under a separate written agreement, and all information is subject to verification, errors, omissions, prior sale, change of price, and withdrawal without notice.

Not intended to solicit properties already listed for sale or buyers or sellers already under contract. If your property is currently listed with another brokerage, or you are already represented, this is not a solicitation of that business.

2. Not professional advice

Nothing on this site is legal, accounting, tax, appraisal, financing, planning, or investment advice. Real-estate decisions carry material financial and legal consequences. Obtain your own independent professional advice, and satisfy yourself through your own due diligence, before acting on anything you read here.

3. Listing information and approximate locations

Listing details are compiled from sources we believe to be reliable — including third-party listing networks and the listing party — but we do not warrant their accuracy or completeness, and they should not be relied on without independent verification. Measurements, sizes, zoning, permitted uses, financial figures, and availability are approximate or indicative and must be verified.

Locations shown on this site are deliberately imprecise. Because these are off-market opportunities, maps show a general area rather than a property. The circle on a map is not the property, and its centre is not the property’s location. Exact addresses are shared only on request, and normally only after a confidentiality undertaking.

4. Confidentiality of exclusive opportunities

Off-market listings are shared in confidence, frequently because a sale becoming public knowledge would damage a business, its staff, or its tenants. If we give you information that is not published on this site, you agree to keep it confidential, to use it only to evaluate the opportunity, and not to disclose or republish it without our written permission. Additional confidentiality agreements may apply to specific opportunities.

5. Acceptable use

You agree not to:

• Scrape, harvest, crawl for bulk extraction, or systematically copy content or listing data from the site
• Attempt to identify a property, its address, or its owner from the approximate information published, or aggregate our content with other sources to do so
• Republish, resell, or redistribute listing content without our written permission
• Use the site to send unsolicited commercial messages, or submit forms under a false identity
• Interfere with the site’s operation or security, or attempt to gain unauthorised access to any part of it
• Use the site for any unlawful purpose or in breach of these terms

6. Enquiries you submit

Information you submit must be accurate and your own. By submitting an enquiry you consent to being contacted about it, including by email. How we handle what you send is set out in our Privacy Policy. We may decline or discontinue any enquiry at our discretion.

7. Intellectual property

The site’s design, text, graphics, photographs, and compiled listing content are owned by us or our licensors and are protected by copyright and trademark law. You may view and print pages for your own non-commercial use in evaluating an opportunity. All other use requires our written permission.

8. Third-party content and links

The site includes mapping from OpenStreetMap and may link to sites we do not control. We are not responsible for third-party content, availability, or practices, and a link is not an endorsement.

9. Brokerage and regulation

Real-estate trading services referred to on this site are provided by StoneCastle Realty Group Inc., Brokerage, a brokerage registered under Ontario’s Trust in Real Estate Services Act, 2002 and regulated by the Real Estate Council of Ontario (RECO). Representation, agency, and the duties owed to you arise only under a signed representation or information agreement with the brokerage — not from your use of this site or from contacting us through it.

10. Disclaimer of warranties

The site and its content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.

11. Limitation of liability

To the fullest extent permitted by law, neither we, the brokerage, nor our respective principals, employees, and agents are liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profit, opportunity, data, or goodwill, arising from your use of or reliance on the site — even if advised of the possibility. Our total aggregate liability for any claim relating to the site is limited to one hundred Canadian dollars (CAD $100).

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

12. Indemnity

You agree to indemnify and hold us and the brokerage harmless from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the site, or your breach of a confidentiality obligation under section 4.

13. Governing law

These terms are governed by the laws of the Province of Ontario and the laws of Canada applicable in it. You agree to the exclusive jurisdiction of the courts of Ontario, subject to any right you have to bring a claim in your own jurisdiction of residence under applicable consumer protection law.

14. Changes to these terms

We may revise these terms at any time. The “last updated” date shows the current version, and continuing to use the site after a change means you accept it.

15. General

If any provision of these terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between us regarding the site.
