The Unlisted GTA (“we”, “us”, “the site”) is an off-market real-estate service operated in partnership with StoneCastle Realty Group Inc., Brokerage. We take the confidentiality of both buyers and sellers seriously — discretion is the reason this service exists — and this policy explains, in plain language, what personal information we collect, why we collect it, who we share it with, and how you can control it.
We handle personal information in accordance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and, where they apply, Ontario’s real-estate rules under the Trust in Real Estate Services Act (TRESA).
1. Information we collect
Information you give us
When you submit an enquiry, a property request, or a seller form, we collect:
- Your name and email address (required, so we can reply)
- Your phone number (optional)
- Your financing status, where you choose to tell us
- Any message you write, and the listing or page the enquiry relates to
Please do not send us sensitive personal information — financial account numbers, government identifiers, or health information — through the website forms. We never ask for it, and the forms are not built to receive it.
Information collected automatically
When you browse the site we record ordinary technical information: the pages you view, the site or search that referred you, campaign tags in the web address (such as UTM parameters), your approximate location derived from your IP address, and basic browser and device details. Your IP address is also used briefly to rate-limit form submissions and block automated spam.
Cookies and similar technologies
The site sets a small number of cookies that are strictly necessary for it to work — for example, to keep a session active or to remember that you have submitted a form. If and when we enable web analytics, those services set their own cookies to measure how the site is used; where consent is required, we will ask for it before they load. You can block or delete cookies in your browser settings, though parts of the site may stop working correctly if you block the necessary ones.
2. Why we collect it
We use personal information only for purposes a reasonable person would consider appropriate in the circumstances:
- To answer your enquiry and send you details of the property or opportunity you asked about
- To send follow-up messages about that enquiry — typically an immediate acknowledgement and up to two reminders — which you can stop at any time
- To match you against off-market opportunities that fit what you told us you were looking for
- To arrange viewings, appointments, and introductions through the brokerage
- To maintain our records, understand how the site is used, and improve it
- To meet legal, regulatory, insurance, and professional obligations, including record-keeping requirements that apply to registered real-estate brokerages in Ontario
3. Consent
When you submit a form, you consent to us collecting and using your information for the purposes above and to us contacting you about your enquiry, including by email under Canada’s Anti-Spam Legislation (CASL). Browsing the site alone implies consent only to the technical collection described above.
You may withdraw your consent at any time. Use the unsubscribe link in any email we send, or write to [email protected]. Withdrawing consent means we will stop contacting you, though we may need to keep a limited record where the law requires it.
4. Who we share it with
We do not sell your personal information, and we do not rent or trade mailing lists. We share it only in these situations:
- The brokerage. Enquiries are handled by a registered representative of StoneCastle Realty Group Inc., Brokerage, who will contact you about your enquiry.
- Counterparties to a transaction. If you ask us to pursue a specific opportunity, we share what is necessary with the listing party or their representative — normally after a confidentiality undertaking is in place.
- Service providers. Companies that host the website, deliver our email, and run the customer-relationship system that stores enquiries. They act on our instructions, may process data on servers located in Canada or the United States, and are bound to protect it. Where information is held outside Canada, it may be accessible to the courts and authorities of that country.
- Where the law requires it — a court order, a regulator such as the Real Estate Council of Ontario, or to establish or defend a legal claim.
Maps on this site
Listing pages display an approximate-area map built with OpenStreetMap. When a map loads, your browser requests map images directly from the OpenStreetMap Foundation, which receives your IP address as part of that request. We do not send them any of your other information. Note also that the circle shown on a map is deliberately approximate and is not the location of the property.
5. How long we keep it
We keep enquiry records for as long as needed to serve you and to meet our legal and professional obligations — generally seven years for records connected to a real-estate transaction, which is the retention period Ontario brokerages are held to. Enquiries that do not lead to a transaction are reviewed periodically and deleted or anonymised once they no longer serve a purpose.
6. How we protect it
The site is served over encrypted connections (HTTPS). Access to enquiry records is limited to those who need it, and administrative access is protected by individual accounts and strong authentication. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but we take reasonable steps proportionate to the sensitivity of the information.
7. Your rights
Subject to limited legal exceptions, you may:
- Ask what we hold about you and get a copy of it
- Correct anything inaccurate or incomplete
- Withdraw your consent and ask us to stop contacting you
- Ask us to delete information we no longer need to keep
- Complain about how we have handled your information
Write to [email protected]. We will respond within 30 days. We may need to verify your identity first. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada at priv.gc.ca.
8. Children
This site is intended for adults transacting in commercial and residential real estate. We do not knowingly collect personal information from anyone under 18. If you believe a child has provided us with information, contact us and we will delete it.
9. Other websites
Our pages may link to sites we do not control. This policy does not apply to them, and we are not responsible for their privacy practices. Read their policies before giving them your information.
10. Changes to this policy
We may update this policy as the site or the law changes. The “last updated” date at the top always reflects the current version. Material changes affecting how we use information you already gave us will be communicated directly where practical.
